Tiemann Industrial Supply further disclaims any responsibility for direct or consequential damages to the purchaser or any other person for injury to person, or damage to or loss of property, or damage to business, or loss of use of property caused by any goods sold, leased, or repaired by us.

We assume no liability for damages or any other expenses incurred as a result of improper materials shipped or because of delay in shipment, or through failure to ship, or for non-delivery of goods on a specified date due to fire, flood, strikes, accidents, government negotiations, delay of carriers, or other causes beyond our control.

LIMITED WARRANTY

All goods in this catalog are advertised for purchase by buyer "as is." TIEMANN INDUSTRIAL SUPPLY MAKES NO WARRANTY, EXPRESSED OR IMPLIED, AS TO MERCHANTABLE CONDITION OF GOODS ILLUSTRATED AND DESCRIBED IN THIS CATALOG OR THAT SUCH GOODS ARE FIT FOR ANY PARTICULAR PURPOSE. Any warranty offered by a manufacturer applies and extends only to the original purchase of new goods.

Our liability for damages, including direct and indirect as a result of a breach of manufacturer's warranty, shall not exceed such manufacturer's warranty.

Copies of warranties are available and will be furnished to customers upon request.

ORDERING MERCHANDISE

Best service can be provided and errors minimized if complete descriptive information is given when ordering. Please specify Tiemann Industrial Supply item reference numbers, quantities desired, catalog numbers, sizes, dimensions, figure numbers, and styles. Complete shipping instructions and required delivery date are also essential.

TERMS

Tiemann Industrial Supply terms are 1%-10, Net 30 days, payable at our offices, unless otherwise stated on the invoice. Tiemann Industrial Supply accepts cash, checks, COD, Visa, Mastercard and American Express. Interest on outstanding balances may be charged at not more than the legal rate after due date of invoice, plus attorney's fees, and/or all court fees and collection expenses, should they be required, in collection efforts.

TAXES

Tiemann Industrial Supply will accept a valid exemption or resale certificate from customers. However, if a certificate previously accepted is not recognized by the taxing authority, the customer agrees to promptly pay us the taxes due. Such taxes will be billed separately to the customer.

SHIPMENT CLAIMS

Check each shipment upon receipt and note receiving exceptions in writing on delivery documents. Report errors within seven days of receipt. If damage is concealed, keep packing materials and call for instructions. If received on our truck, Tiemann Industrial Supply will make good any damage or shortage.

CREDIT APPROVAL

Shipment and delivery shall be subject to approval of our Credit Department. To avoid delay, purchasers who do not have an account with us may accompany their orders with sufficient, satisfactory credit information and references to initiate establishment of an open account. Customers who do not have an account with Tiemann Industrial Supply will be asked to pay with a Credit Card.

FREIGHT CHARGES

Customers requesting common carrier or other special shipping services will be expected to bear the cost of same unless otherwise agreed. Customers may incur nominal charges for delivery to defray our cost for this service.

QUOTATIONS

Quotations are for immediate acceptance and are valid for no more than 30 days unless otherwise stated. Prices quoted are on the basis of F.O.B. point of origin, unless otherwise specified. All clerical errors in quotations are subject to correction.

RETURNED GOODS

Unless Tiemann Industrial Supply has erred, all returns must be freight prepaid and are the responsibility of the customer.

Stocked merchandise may be returned for credit or exchange WITH OUR PRIOR CONSENT. In some cases, a restocking charge may be charged. Please contact our Customer Service Department for a returned goods authorization (RGA) PRIOR to returning any goods to Tiemann Industrial Supply.

All requests for returns must be made within 45 days of the original invoice date.
